1. Agreement to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

By using the Site, you represent and warrant that:
  1. You are at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater)
  2. You are a legal resident of the United States
  3. You have the legal capacity to enter into a binding contract
  4. You are not prohibited from using the Site or purchasing our products under applicable law
  5. You will use the Site only for lawful purposes and in accordance with these Terms
Our products are dietary supplements intended for adults. We do not knowingly sell to persons under 18. If you are under 18, you may not use this Site or purchase our products.

3. Products and Dietary Supplement Disclaimer

3.1 Nature of Products

BloomRenew sells dietary supplements and functional food products regulated under the Dietary Supplement Health and Education Act of 1994 (DSHEA) and applicable FDA regulations. Our products are not drugs and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

3.2 Not Medical Advice

No content on our Site — including product descriptions, blog articles, ingredient information, or customer testimonials — constitutes medical advice. The information is provided for educational and informational purposes only.
Consult a qualified healthcare professional before using any dietary supplement, particularly if you:
  • Are pregnant, planning to become pregnant, or breastfeeding
  • Are under 18 years of age
  • Have a diagnosed medical condition
  • Are taking prescription or over-the-counter medications
  • Have known allergies or sensitivities to any ingredients

3.3 Allergen Notice

Certain BloomRenew products contain ingredients derived from milk (coconut milk powder, which may contain trace dairy proteins). Review the full ingredient list and allergen information for each product before purchasing. See individual product pages for complete allergen declarations.

3.4 Individual Results

Product benefits described on our Site are based on the ingredient research cited in our educational content. Individual results vary and are not guaranteed. The experiences described in customer testimonials may not be typical.

4. Account Registration and Security

4.1 Account Creation

You may browse the Site without creating an account. However, certain features (order history, subscription management) require a registered account. When you register, you must provide accurate, current, and complete information.

4.2 Account Security

You are responsible for:
  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@bloomrenew.com if you suspect unauthorized access
We are not liable for losses resulting from unauthorized use of your account where you failed to maintain reasonable security practices.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason with or without notice.

5. Orders, Pricing, and Payment

5.1 Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is accepted when we send you an order confirmation email. If we cannot fulfill an order (due to inventory limitations, pricing error, or other reasons), we will notify you and issue a full refund if payment was taken.

5.2 Pricing

All prices are displayed in US Dollars (USD) and are subject to change without notice. Prices at the time of order placement are binding for that transaction once you receive an order confirmation.
We make reasonable efforts to ensure pricing accuracy. In the event of a pricing error:
  • If the correct price is lower than displayed, we will charge the lower amount and notify you
  • If the correct price is higher than displayed, we will notify you before processing and give you the option to proceed at the correct price or cancel

5.3 Taxes

You are responsible for all applicable sales taxes, use taxes, and similar charges based on your location. Shopify's tax calculation tools are used to estimate applicable taxes; BloomRenew is responsible for tax remittance where required.

5.4 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express, Discover), PayPal, Shop Pay, Apple Pay, Google Pay, and other payment methods displayed at checkout. By submitting payment information, you authorize us to charge your selected payment method for the full order amount including taxes and shipping.

5.5 Fraud Prevention

We use automated fraud screening tools. Orders flagged as potentially fraudulent may be held for review or cancelled. If we cancel an order for fraud prevention reasons, we will refund the charged amount.

5.6 Subscription Orders

If you enroll in a subscription, you authorize recurring charges at the stated frequency until you cancel. You may cancel a subscription at any time through your account portal or by contacting us at support@bloomrenew.com at least 24 hours before your next scheduled billing date to avoid the next charge. We do not offer refunds on subscription orders that have already been processed and shipped except as provided in our Refund & Return Policy.

6. Shipping

Shipping is governed by our Shipping Policy, incorporated into these Terms by reference. Key points:
  • We currently ship to addresses within the contiguous United States, Alaska, and Hawaii only. We do not offer international shipping.
  • We are not responsible for delays caused by shipping carriers, weather, acts of God, or other circumstances beyond our control.
  • Risk of loss and title for products pass to you upon delivery to the carrier.

7. Returns and Refunds

Returns and refunds are governed by our Refund & Return Policy, incorporated into these Terms by reference. Key points:
  • We offer a 30-day satisfaction guarantee on first-time orders from our Site, subject to the terms of our Refund Policy.
  • Note: Our Amazon marketplace return policy is separate and governed by Amazon's policies; the satisfaction guarantee described here applies only to orders placed directly through our Site.

8. Intellectual Property

8.1 Our Content

All content on the Site — including but not limited to text, graphics, logos, product images, blog articles, videos, and software — is owned by or licensed to BloomRenew and is protected by US copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, or create derivative works from any content on the Site without our prior written permission, except as permitted by applicable law (e.g., fair use).

8.2 Trademarks

"BloomRenew" and associated logos are trademarks of [1:Legal Entity Name, e.g. BloomRenew LLC]. Other product names, company names, and logos mentioned on the Site may be trademarks of their respective owners (e.g., KSM-66® is a registered trademark of Ixoreal Biomed Inc.).

8.3 User Content

If you submit reviews, photos, comments, or other content ("User Content") to our Site or social media channels, you grant BloomRenew a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, publish, and distribute that User Content for marketing, promotional, and operational purposes, including on our Site, social media, and advertising materials. You represent that you own or have the right to submit the User Content and that it does not infringe third-party rights.

9. Prohibited Conduct

You agree not to:
  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the Site or related systems
  • Use automated scripts, bots, scrapers, or crawlers to access the Site without permission
  • Transmit viruses, malware, or other malicious code
  • Submit false, misleading, or fraudulent orders or information
  • Engage in any conduct that could damage, overburden, or impair the Site
  • Resell or commercially redistribute our products without prior written authorization
  • Make false, defamatory, or misleading statements about BloomRenew or its products
  • Use our intellectual property without permission

10. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES
  • WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF CONTENT
SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES. IF SUCH LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS MAY NOT APPLY.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLOOMRENEW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR:
  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
  • ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR PRODUCTS
  • ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
SOME STATES DO NOT ALLOW LIMITATIONS ON LIABILITY FOR CONSEQUENTIAL DAMAGES. THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless BloomRenew and its officers, directors, employees, agents, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
  • Your use of the Site or products
  • Your violation of these Terms
  • Your violation of any third-party right
  • Your User Content

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the [2:Incorporation State, e.g. Delaware], without regard to its conflict of law provisions.

13.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at support@bloomrenew.com and attempt to resolve the dispute informally for a period of 30 days. Many concerns can be resolved quickly through our customer service team.

13.3 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
Key arbitration terms:

  • The arbitrator shall apply the governing law stated in Section 13.1
  • Each party bears their own attorneys' fees unless the arbitrator determines a party's claim was frivolous

CLASS ACTION WAIVER: Both you and BloomRenew waive the right to participate in any class action lawsuit or class-wide arbitration. All claims must be brought in your or our individual capacity only.
EXCEPTION: Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm. Small claims court matters are excluded from mandatory arbitration.

13.4 Jury Trial Waiver

YOU AND BLOOMRENEW WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.

14. Third-Party Services and Links

Our Site uses third-party services (Shopify, Google Analytics, Meta Pixel, etc.) and may contain links to third-party websites. We do not control and are not responsible for the content, privacy practices, or actions of any third-party services or websites. Your use of third-party services is governed by their own terms and policies.

15. Force Majeure

BloomRenew shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, labor disputes, governmental actions, cyber attacks, supply chain disruptions, or carrier failures.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the enforceability of the remaining provisions.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and BloomRenew regarding your use of the Site and supersede all prior agreements and understandings.
